Introduction

This website and any related pages or booking interfaces (collectively, the “Site”) provide information about Maldevta Farms, Dehradun (the “Hotel”, “we”, “us”, “our”) and enable online reservations for rooms, events/banquets, activities and other services. Accessing, browsing, using, viewing, transmitting, caching, or storing the Site or any of its content constitutes your agreement to these Terms & Conditions (“Terms”). If you do not agree, please discontinue use of the Site.

1) Scope of the Site

The Site offers information about our rooms, packages, restaurants/food services, day-outings, activities, banquets/events, and enables you to make legitimate reservations and service requests for yourself and your invited guests.

2) Acceptance of Terms

By using the Site, you confirm that you have read, understood, and agree to be bound by these Terms and any additional terms that may apply to specific services (e.g., rate rules, cancellation policies displayed during booking).

3) Eligibility & Account Security

You must be at least 18 years of age and able to form a legally binding contract to use the Site. You are responsible for maintaining the confidentiality of any login credentials and for all activity conducted under your account.

Trademarks

The names, logos, and marks identifying the Hotel and our services are our trademarks or service marks. You may not use any mark in a way that is confusing, misleading, dilutive, or disparaging.

You may print or download limited portions of the Site solely for personal, non-commercial use, provided you keep all copyright and proprietary notices intact. Any other use is prohibited without prior written permission.

5) Permitted & Prohibited Use

The Site is provided for personal, lawful, non-commercial use only. You agree not to:

• use any robot, spider, scraper or other automated means to access the Site without our written consent;
• attempt to gain unauthorized access to the Site, servers, or networks;
• use the Site or its content to train or improve AI/ML models or for data mining, dataset creation, or similar purposes;

• use the Site for false, speculative, or fraudulent reservations.

We reserve all rights to restrict, suspend, or terminate access in case of misuse.

6) Information & Availability

We strive to keep information (including rates and availability) accurate and current; however, errors and omissions may occur and information may change without notice. Your use of the Site is at your sole risk and the Site is provided “as is” and “as available” to the maximum extent permitted by law.

7) Reservations & Check-in Requirements

By making a reservation, you warrant that all information supplied is true and accurate and that you will use the reservation only for your stay or for invited guests.

• Rate rules, taxes & fees: The rate and applicable taxes/fees for your selected dates and room type will be shown at the time of booking. Local taxes, service charges, and government levies may change and will be charged as applicable at check-in/checkout.
• Guarantee & payment: A valid payment method may be required to guarantee your booking. We may pre-authorize your card as per rate rules.
• Cancellations/No-shows/Modifications: The specific policy displayed at booking applies (varies by rate, dates, and room type). No-show or late cancellation charges may apply.
• Check-in documents: As per Indian law, valid government photo ID is required for all staying guests. International guests must present passport and visa as applicable.
• Minors: Guests under 18 must be accompanied by a parent/guardian.
• Third-party/OTA bookings: If you reserve through an OTA or agent, their terms may apply in addition to these Terms.

8) Payments, Deposits & Incidentals

You authorize us to charge your card for room charges, applicable taxes, service charges, deposits, prepayments, and incidentals (e.g., dining, activities, damages) incurred during your stay or event. Security deposits or pre-authorizations may be taken at check-in or before events/banquets.

9) Events/Banquets, Activities & Facilities

For banquets, weddings, corporate functions, school day-outs, and activities:

• Bookings & vendors: External vendors (decor/AV, photography, entertainment) may require prior approval and documentation.
• Licenses & compliance: Organizers are responsible for securing any required licenses/permissions (e.g., music performance rights) and for compliance with laws, safety, and Hotel rules.
• Damage & safety: You are responsible for damages or losses caused by you, your guests, or vendors. Certain activities may have age/health advisories and require adherence to staff instructions and safety guidelines.
• School/children programs: The organizer (school/institution) is responsible for obtaining guardian permissions and for supervising minors.

10) Gift Vouchers, Promotions & Packages

Promotional offers, packages, and vouchers are subject to their specific terms, validity periods, blackout dates, and availability. They are non-transferable and may not be combined unless expressly stated.

11) User Content & Communications

Any feedback, reviews, suggestions, or other content you submit may be used by us for service improvement and marketing (in accordance with the Privacy Policy and with consent where required). You are responsible for ensuring your submissions are lawful and do not infringe third-party rights.

12) Third-Party Links

The Site may contain links to third-party websites (e.g., payment gateways, OTAs, social platforms). We do not control and are not responsible for their content or privacy practices. Access at your own risk.

13) Privacy & Data Protection

Your use of the Site is subject to our Privacy Policy, which explains how we collect, use, share, and protect personal data (including CCTV on premises, Wi-Fi logs, call recordings for quality/training, etc.). 14) Disclaimers

To the maximum extent permitted by law, we disclaim all warranties (express, implied or statutory), including merchantability, fitness for a particular purpose, title, non-infringement, and continuous, error-free availability of the Site. Information is provided for general guidance; you should verify critical details before relying on them.

15) Limitation of Liability

To the maximum extent permitted by law, the Hotel will not be liable for any indirect, incidental, special, punitive or consequential losses (including loss of profits, data, goodwill, or business interruption) arising out of or in connection with the Site, your booking, or your stay. Our aggregate liability for direct damages shall not exceed the total amount paid by you for the reservation/event giving rise to the claim.

16) Indemnity

You agree to indemnify, defend and hold harmless the Hotel, its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of your breach of these Terms, misuse of the Site, violation of law or third-party rights, or negligence/misconduct by you or your invitees/vendors.

17) Force Majeure

We are not liable for any failure or delay in performing obligations due to events beyond our reasonable control, including acts of God, natural disasters, epidemics, war, terrorism, strikes, utility failures, or government actions.

18) Termination/Suspension

We may suspend or terminate your access to the Site, or cancel any reservation for fraud, misuse, non-payment, or material breach of these Terms. Provisions that by their nature should survive termination (e.g., intellectual property, limitations of liability, indemnities) will survive.

19) Governing Law & Dispute Resolution

These Terms and any dispute arising out of or in connection with them shall be governed by the laws of India.

Arbitration. Any dispute shall be finally resolved by arbitration under the Arbitration and Conciliation Act, 1996 (and amendments). The seat and venue of arbitration shall be Hyderabad, Telangana. The proceedings shall be conducted in English before a sole arbitrator appointed mutually by the parties; failing agreement, the arbitrator shall be appointed in accordance with the Act. Each party shall bear its own costs, and the arbitrator may apportion costs in the award. Either party may seek interim or injunctive relief from competent courts in Hyderabad.

20) Jurisdiction

Subject to arbitration, courts at Dehradun, Uttarakhand shall have exclusive jurisdiction.

21) Changes to These Terms

We may update these Terms from time to time. The “Last updated” date indicates the latest version. Continued use of the Site after changes constitutes acceptance of the updated Terms.
